Welcome to Tukio Images. By accessing or using our website, marketplace, and services (“Platform”), you agree to be bound by the following terms and conditions (“Terms”). Please read them carefully. If you do not agree to these Terms, do not use Tukio Images.

These Terms constitute a binding legal agreement between you (“User”, “Photographer”, “Contributor”, or “Buyer”) and Tukio Images (“we”, “our”, “us”).

1. Definitions

• Tukio Images – A digital photography platform offering African editorial and commercial stock images for download or purchase.

• Contributor – A photographer or content creator who uploads and licenses images through Tukio Images.

• Buyer – Any person or entity that purchases or downloads content for use.

• Content – Any images, photographs, captions, or metadata uploaded or available on Tukio Images.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your country to use our services. By creating an account, you represent that you meet these requirements.

3. Account Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

Tukio Images reserves the right to suspend or terminate accounts that provide false information or violate platform guidelines.

4. User Conduct

You agree not to:

• Upload, share, or license content that infringes on copyrights, trademarks, or rights of privacy/publicity.

• Use the Platform for unlawful, harmful, or exploitative purposes.

• Impersonate any person or entity or misrepresent your affiliation.

• Interfere with the functioning or security of the website.

5. Licensing of Content

All images on Tukio Images are governed by licensing agreements — either Editorial or Commercial. You agree to abide by the specific license terms attached to each image you purchase or download.

5.1 Editorial Use Only

These images may be used for non-commercial, newsworthy, or educational contexts and must not be altered or used for brand promotion.

5.2 Commercial Use

These images may be used for advertising, brand campaigns, and commercial projects as specified in the license.

6. Contributor Terms

Contributors retain the copyright to their work. However, by uploading content to Tukio Images, you grant us a non-exclusive, worldwide, royalty-free license to:

• Display, market, and sell your images via the platform.

• Use your content for promotional and educational purposes, with proper attribution.

Contributors earn a commission on each sale, as detailed in our Contributor Agreement.

You must only upload images you have the legal rights to license, and you must provide model or property releases when required.

7. Payments & Fees

• Buyers agree to pay listed prices for content, plus any applicable taxes or processing fees.

• Contributors will be paid according to our commission structure via selected payment methods.

• Tukio Images reserves the right to modify fees or commissions with prior notice.

8. Refunds

Refunds are only provided in cases of technical failure (e.g. corrupted file) or incorrect licensing. Due to the digital nature of our content, all purchases are final once files are downloaded.

9. Intellectual Property

All content and materials on the Tukio Images platform, including text, design, and logos, are protected by copyright and intellectual property laws. Unauthorized use or duplication is prohibited.

Buyers may not resell, sublicense, or redistribute images in a competing service or in violation of the license terms.

10. Disclaimers

Tukio Images provides content “as is” and does not guarantee the accuracy, completeness, or availability of any content. We are not liable for any misuse of content downloaded from the platform.

11. Limitation of Liability

Tukio Images is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the platform or content.

12. Termination

We reserve the right to terminate or suspend any account at our discretion, with or without notice, especially in cases of copyright infringement, fraudulent behavior, or platform abuse.

13. Modifications to the Terms

We may update these Terms occasionally. Changes will be posted on this page, and continued use of the platform constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Kenya (or insert jurisdiction of legal incorporation). Any disputes will be subject to the exclusive jurisdiction of Kenyan courts.
