When you license an image from Tukio Images, you are granted specific rights to use the image, but the copyright ownership always remains with the original photographer. Please read the following terms carefully to understand your usage rights and obligations.

Understanding Image Licensing

Image licensing is a legal agreement that grants you permission to use an image under defined terms and conditions. These terms specify how, where, for how long, and for what purpose an image can be used. It is essential to adhere to these terms to ensure legal compliance and avoid unauthorized use.

Types of Licenses Offered by Tukio Images

At Tukio Images, we primarily specialize in providing images for editorial use. Any other forms of licensing are subject to direct inquiry to ensure specific needs can be met and proper terms are established.

1. Editorial License

Our Editorial License is designed for use in connection with events that are newsworthy or of general public interest. This license is suitable for use in journalistic, educational, or informational contexts.

Key Terms of Use:

• Permitted Uses:

  • News articles, magazines, newspapers, and other print publications.

  • Blogs, online news sites, and digital publications (where the primary purpose is informational or illustrative, not promotional).

  • Documentaries, non-fiction books, and educational materials.

  • Public service announcements and social media posts directly related to a newsworthy event or public interest topic.

  • Presentations, reports, and academic works, provided they are non-commercial.

• Prohibited Uses (Commercial Use Strictly Forbidden):

  • Advertising, marketing, or promotional materials (e.g., product packaging, brochures, billboards, commercial websites, social media advertisements).

  • Endorsements of any product, service, company, or political candidate.

  • Merchandise or products for resale (e.g., T-shirts, posters, greeting cards, calendars, art prints).

  • Use in logos, trademarks, or any branding elements.

  • Any use that implies endorsement, sponsorship, or association with a commercial entity or product.

  • Defamatory, libelous, obscene, or illegal use.

  • Alteration or modification of the image beyond standard cropping, resizing, or minor color correction, without explicit written permission. The integrity of the visual story must be maintained.

• Attribution:

  • For all editorial uses, clear and conspicuous attribution to "Photographer Name/Tukio Images" must be included directly adjacent to the image or in a clearly visible credit section.

  • Specific photographer names will be provided with each licensed image where applicable.

• Model and Property Releases: Images licensed for Editorial Use may not have model or property releases. This means they cannot be used for commercial purposes as defined above. It is your responsibility to ensure your use complies with this restriction.

2. Other License Types (Subject to Inquiry)

While our primary focus is on editorial content, we understand that our diverse collection may contain images suitable for other purposes. For any licensing needs beyond the scope of an Editorial License, such as:

• Commercial Use: For advertising, marketing, product packaging, promotional materials, or any use intended to generate revenue or promote a product/service.

• Rights-Managed (RM): For highly specific uses with defined parameters (e.g., duration, geographic territory, exclusivity).

• Extended/Enhanced Licenses: For larger print runs, use on merchandise, or other expanded rights.

General Terms and Conditions Applicable to All Licenses

• Copyright: All images displayed on www.tukioimages.com are protected by copyright law. Tukio Images and its contributors retain all intellectual property rights not explicitly granted in the license.

• No Transfer of Ownership: Licensing an image does not transfer ownership of the copyright. You are granted a non-exclusive (unless explicitly agreed otherwise for custom licenses), non-transferable right to use the image as specified.

• No Sublicensing: You may not sublicense, resell, rent, loan, or otherwise transfer the image or your rights to use it to any third party.

• Unlawful Use: Images may not be used in any way that is unlawful, defamatory, pornographic, or otherwise offensive.

• Misrepresentation of Authorship: You may not falsely represent yourself as the original creator of any image.

• Indemnification: You agree to indemnify and hold harmless Tukio Images and its contributors from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these licensing terms or your unauthorized use of any image.

• Changes to Terms: Tukio Images reserves the right to modify these licensing terms at any time. Any changes will be effective from the "Effective Date" stated at the top of this page. It is your responsibility to review these terms periodically.

• Governing Law: This agreement shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.
